Terms of Agreement

• VENDORS AUTHORITY
You warrant that you are the owner of this property and you have the authority to enter into this Agreement.

• AGENCY PERIOD
This Agreement will commence now and will conclude once your subscription period ends or as soon as you have requested the Agreement to end. You can request the Agreement to end by sending an email with such a request to manager@vode.com.au.

This Agreement will end if you request Vode Property to withdraw your property from sale.

WARNING: Have you signed an agency agreement for the sale or lease of this property with another agent? If you have you may have to pay them commissions (if the other agreement you have signed is a sole or exclusive agency agreement).

• COMMISSION

    4.1. Vode Property is entitled to a fixed upfront fee of $299 for 3 months (Inclusive of GST) for each property listed with our agency in return for performing all functions subject to this Agreement.
    4.2. You will be charged no other fees or commissions for the services performed by Vode Property during or after the sale or lease of your property.
    4.3. You will be charged no disbursements or expenses during the marketing campaign or once your property is sold or leased.

• WHERE YOUR PROPERTY WILL BE ADVERTISED

    An online advertisement will be placed on each of the following real estate advertising websites for 3 months
    Note: Your property will not appear on www.realestate.com.au and www.property.com.au if the property is located in ACT, SA, NT, or WA.
    The following websites www.justlisted.com.au, www.cracker.com.au, www.ebay.com.au and www.ninemsn.com.au receive their listings from Domain. In most instances your listing will be forwarded from Domain to these websites, however on occasions Domain may not forward your property listing to these websites so we can not guarantee your listing will always appear on them.
    Propertypoint.com.au only accepts properties which are located in Tasmania.

• ANSWERING ENQUIRIES

  • All telephone and email enquiries we receive in relation to your property will be forwarded to your email and a text message sent to your mobile.

• RESPONSIBILITY OF YOU

  • You agree that you will have a legal Contract of Sale drawn up for your property and that you will make it available to all open inspection attendees and all prospective purchasers at a time which is convenient for both you and the prospective purchaser.
  • You agree that you will not misrepresent your property in relation to the advertising material you provide and that all advertising material you provide is a true reflection of your property.
  • You will request via email to manager@vode.com.au all open inspection times you would like included in your property listing.
  • You acknowledge that you will be present and perform all open inspections as per the dates and times which are advertised in your property listing.
  • If you would like to amend any of the open inspection times or any other information found in your property listing, you can request this by sending an email to manager@vode.com.au. We require a minimum of 12 hours notice before we can guarantee a listing will be updated.
  • You agree that within 24 hours of a sale or leasing contract being entered into you will inform Vode Property via way of email that the property is either “Under Contract”, “Leased” or “Sold”. You can inform Vode Property by sending an email to manager@vode.com.au.

• LIMITATION OF DUTIES

  • You accept that Vode Property does not guarantee that through using our service you will sell or lease your property or that you will receive enquiries in relation to your property.
  • Vode Property do not guarantee that any of the 3rd party websites we export your property information to will continue to list your property with their website. We are not liable to compensate you if any of these 3rd party websites choose not to continue to list your property on their website.

• LIMITATION OF LIABILITY
To the extent permitted by law, you agree that you will not hold us liable for and will indemnify us against any liabilities, expenses, losses, damages or costs (including but not limited to legal costs on a full indemnity basis), that may be incurred by you or a third party as a result of us performing our services.

• CONSUMER GUIDE
You acknowledge that Vode Property has provided you with a link to the Office of Fair Trading “the Agency Agreement Fact Sheet”.

All prices quoted within this Agreement are inclusive of GST
